I've got some real exposure to police issues, not only intellectually....
Mark S. McCarty, Attorney
When asked why McCarty decided to go into police-related law, he said:
"I’ve got some real exposure to police issues, not only intellectually, but now every night I worry about my son. I know a lot of people will say that means that I am probably biased on behalf of police officers but it’s the opposite, because my son is a good soul, and I want him working with good officers. I don’t want him working with bad officers."
Experiences on both sides of the table are precisely what give McCarty the credibility and experience to be of value to police departments today. He understands the nuances of legal processes, especially those related to police work and, particularly, police shootings.
McCarty has been recognized for the quality of his counsel on numerous occasions and is a Martindale-Hubbell AV Preeminent Attorney. He received his JD from the Duke University School of Law and is a member of the American Bar Association. Currently, he primarily serves as an arbitrator and consultant.
As a thought-leader in his industry, McCarty represents a valuable resource to managers in their handling of crises and complicated situations. He noted:
" I have so much experience dealing with really tough issues of humans in crisis situations. Here’s an interesting stat: the average police gunfight lasts 2.1 seconds. It’s not a big shoot out. It’s usually one shot. ... So investigations have to be done correctly... There are these two legal worlds coming together. You have an employment world and employment law. But you also have at least the potential for a criminal charge. And you don’t want to screw that up, if you’re the police chief, if you’re the city that’s employing this officer. But it’s very easy to get wrong. It can go wrong very quickly. That’s really my expertise."
