Courts can get around that by calculating alimony first and then basing the child support payments on the adjusted alimony allocated income.
Andrea McKnight, Attorney at Law
With over 10 years of experience dedicated to law, McKnight brings a wealth of knowledge to her industry, and, in particular to her areas of specialization, domestic relations (including family law, divorce, child support, custody), landlord-tenant disputes, zoning, and civil litigation. When asked why she decided to pursue a career in law, McKnight said:
"I went to college without the slightest clue of what I wanted to do but knew I loved athletics and that I wanted to coach or become a teacher. Halfway through my undergrad I took my first law class and loved it. After graduating, I became a boarding school teacher thinking that I could coach and teach and it’d be amazing. Ironically, I absolutely hated it. I then went to teach kindergarten, and that wasn’t a match for me either. I thought back to how much I loved those law courses in college, and so I applied to law school and off I went."
As a thought-leader in her industry, McKnight remains at the forefront of prevailing trends in family law in her state. In particular, she has been closely following recent changes in Massachusetts’ guidelines for how to allocate alimony and child support after a divorce. She noted:
"In circumstances where one parent earns significantly more than the other, but the higher-earning parent also has custody of the children, the courts are faced with this conundrum of balancing alimony and child support payments. If the court were to calculate child support first, then there’s no alimony going to the parent with lower or sometimes no income. Courts can get around that by calculating alimony first and then basing the child support payments on the adjusted alimony allocated income."
McKnight has been recognized in the Super Lawyers® list of Massachusetts Rising Stars since 2013. She was named a New England Outstanding Young Lawyers in 2014 and was named the Massachusetts Outstanding Young Woman Lawyer in 2014 and 2016.
